The Office of the Controller of Budget (OCOB) was established by the Constitution of Kenya 2010, under Article 228 and became operational upon the appointment of the Controller of budget on 27th August 2011. Prior to this, some of the functions of the Office of the Controller of Budget were performed by the Controller and Auditor General and the Treasury while others did not exist.
Two new independent constitutional offices were therefore created by splitting the control function of the Controller and Auditor General into the Office of the Controller of Budget and the Auditor General under Articles 228 and 229.
Purpose of the job:
Reporting to the Director – Legal Services, the Deputy Director – Legal Services will be responsible for the implementation of the legal services strategy and plans, and provision of legal advice to the Office.
Duties and Responsibilities
- Provide professional guidance to Management and staff on all legal matters relating to the mandate, functions and operations of the Office on all areas of law;
- Participate in the development and implementation of the Legal Directorate’s strategy and plans;
- Coordinate and monitor all litigation instituted against and on behalf of the Office to ensure the best results for the Office in such litigation;
- Participate in the preparation and implementation of the legal services budget;
- Provide professional advice to the Office on legal matters, policies and procedures to enhance compliance, hence reducing reputational, legal and financial risks;
- Participate in drafting, review and interpretation of contracts/agreements between the Office and other parties;
- Carry out searches at the registries i.e. lands, company registry and court files as appropriate in support of legal decisions;
- Prepare legal documentation and legal briefs to represent the Office in court;
- Appraise the staff within the directorate as per the laid down guidelines.
Requirements for Appointment:
- Bachelor of Law (LL. B) degree from a recognized university;
- Postgraduate Diploma in Legal Studies from the Council of Legal Education;
- Be an advocate for the High Court of Kenya;
- Be a member of good standing of the Law Society of Kenya;
- Be in possession of a current practicing license;
- A Senior Management Course will be an added advantage;
- Proficiency in computer applications;
- At least 12 years relevant experience five (5) of which must have been at the position of Manager – Legal services or its equivalent preferably in the public sector.
